1.      Introduction and Acceptance of Terms

·         "At Fresh Brew Woodworks, we take great pride in creating a seamless and enjoyable experience for our customers. To ensure we're all on the same page, we've outlined our business practices and policies in these Terms and Conditions. Please take a moment to review them, as they form the basis of our agreement once you approve a project with us. We're always here to answer any questions you may have."

2. Custom Order Process

·         Consultation & Design: "All custom orders begin with a consultation to discuss your vision, material preferences, and design specifications. We will provide a detailed quote and design drawing for your approval."

·         Deposits & Payment: "To initiate your custom furniture order, a non-refundable deposit is required. This deposit is calculated to cover the full estimated cost of all necessary raw materials, supplies, as well as the initial labor for design, milling, and preparation. This ensures that we can immediately begin procuring the specific materials for your unique piece. The exact deposit amount will be clearly outlined and itemized on your project quote, and the remaining balance will be due upon project completion and prior to delivery or pickup."

·         Changes to Order: "Once the deposit is received and the design is approved, changes to the order may result in additional fees and may extend the production timeline. Any requested changes must be submitted in writing (text or email)."

·         Approval & Final Product: "The final product will be built to the specifications outlined in the approved design. We strive for perfection, but due to the handcrafted and natural nature of our materials, minor variations in wood grain, color, and finish are to be expected and are not considered defects."

3. Materials and Finishes

·         Natural Variation: "Fresh Brew Woodworks uses a variety of natural materials, locally sourced and exotic hardwoods, which may have unique characteristics such as knots, grain patterns, and slight color variations. These are not considered flaws but are part of the beauty and uniqueness of each piece. Due to the nature of wood, slight movement, checking, or cracking may occur over time due to changes in humidity and temperature. Fresh Brew Woodworks is not liable for such natural occurrences."

·         Finish Durability: "Our furniture is finished with premium, high-quality varnishes and epoxy resins. However, all finishes can be susceptible to damage from scratches, heat, or spills if not properly cared for. We are not responsible for damage caused by misuse or improper care."

4. Delivery, Shipping, and Pickup

·         Delivery/Pickup: "Once your custom furniture is complete and final payment is received, we will contact you to schedule a delivery or pickup time. You are responsible for ensuring the furniture will fit through all doorways and into its intended space."

·         Shipping (if applicable): "For shipped orders, Fresh Brew Woodworks will use a third-party shipping service. We are not liable for any damage that occurs during transit. While we take the utmost care in packaging and preparing your furniture for shipment, any claims for damage must be made directly with the shipping carrier."

·         Storage Fees: "If you are unable to accept delivery or pick up your furniture within a specified time frame [e.g., 15 days] after it is complete, a daily storage fee of [e.g., $15] may be applied."

5. Returns and Cancellations

• "Due to the custom nature of our products, all sales are final. We do not accept returns or offer refunds on custom furniture orders. All deposits are non-refundable. Orders cannot be canceled once the deposit is paid and production has begun."

6. Intellectual Property

• "All designs, concepts, photographs, and website content on www.freshbrewwoodworks.com are the exclusive intellectual property of Fresh Brew Woodworks and may not be used, reproduced, or copied without our express written permission."

7. Limitation of Liability

• "To the maximum extent permitted by law, Fresh Brew Woodworks shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our products. This includes, but is not limited to, damages for loss of profits, property damage, or personal injury, even if we have been advised of the possibility of such damages. Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Fresh Brew Woodworks for the product in question."

8. Governing Law

• "These Terms shall be governed by and construed in accordance with the laws of the State of Kentucky, without regard to its conflict of law provisions."

10. Delivery

At Fresh Brew Woodworks, we take great care to ensure your new furniture arrives safely. Here’s how we handle delivery:

• Local Delivery: We are happy to offer complimentary delivery for all custom furniture orders within a 15-mile radius of us. We'll coordinate a delivery date and time that works best for you.

• Long-Distance Delivery: For deliveries outside of our 15-mile complimentary zone, a delivery and fuel fee will be applied. This fee is calculated based on the distance from our shop and will be included as a line item on your final project quote.

• Customer Pickup: You are also welcome to pick up your completed piece directly from our shop. We'll assist you with loading the furniture, but we are not liable for any damage that occurs once the item has left our premises. Please ensure you have a vehicle and the necessary supplies to transport your furniture safely.
